These Terms of Service govern your use of the Photo Zone Studio website at photozonestudio.com and your booking of the studio floor operated by CTT MEDIA PRODUCTION INC at 5510 S Rice Ave, Houston - 77081-2131, United States (US). By using this website or by holding a booking on the floor, you agree to these terms. Please read them before you send an enquiry or confirm a zone.
The terms are written to be readable. They describe what the studio promises, what a client promises, how a booking is held and released, how paper and equipment are handled, and how a disagreement is resolved. If a written booking agreement sets a term that differs from this page, the written booking agreement controls for that booking.
These terms form a binding agreement between you and CTT MEDIA PRODUCTION INC. The company runs the Photo Zone Studio and provides photography production services from its Houston floor. The company name and address appear again at the end of this page and in the footer of every page of this site.
By browsing this website, by sending an enquiry to the booking desk, or by confirming a zone, you accept these terms on your own behalf and, where you act for a business, on behalf of that business. If you do not accept the terms, please do not use the website and do not confirm a booking.
If any part of these terms is found to be unenforceable, the rest of the terms continue to apply. A delay in enforcing a term is not a waiver of that term.
In these terms, the company means CTT MEDIA PRODUCTION INC. The studio and the floor mean the photo production space at 5510 S Rice Ave, Houston - 77081-2131, United States (US). A zone means a bookable area of the floor. A booking means a confirmed reservation of a zone for a stated period. A client means the person or business that holds the booking. Day of service means the day on which the booking is scheduled.
A run sheet means the record prepared by the booking desk setting out the zone, the paper tone, the light notes and the print window for a booking. Paper means the seamless backdrop material used on the floor. A print evening means a booked darkroom session.
You must be at least eighteen years old, or have the permission of a parent or guardian, to hold a booking in your own name. A business booking must be made by a person with authority to bind that business.
The studio does not run a public account system on this website. Your booking is identified by the contact details you give to the desk. You are responsible for keeping those details current, and for telling the desk promptly if an email address or a telephone number changes.
You are responsible for the acts of people you bring to the floor as though they were your own acts. If a crew member breaches these terms, the breach is treated as a breach by the client.
An enquiry to the desk is not a booking. A booking is made when the desk confirms the zone, the date, the hours and the paper tone, and the client accepts that confirmation in writing. The confirmation is the record of the booking.
The desk may hold a provisional slot for a short period while the client decides. A provisional slot is released if the client does not confirm within the period the desk states. The desk is not obliged to hold a slot beyond that period.
A booking is limited to the zone, hours and service stated in the confirmation. Using an additional zone, running past the booked hours, or changing the service without confirmation is an unbooked use, and the studio may end it or charge the applicable fee for the extra time and space where the floor allows.
The desk can refuse a booking where the requested use is unsafe, where it would breach a law, or where it would damage the floor or the paper in a way the studio cannot manage.
The fee for a booking is the amount stated in the confirmation. The fee covers the zone, the booked hours, the standard paper tone and the studio lighting that the run sheet describes. Special paper, special lighting or extra crew may carry an additional charge, which the desk will state before the booking is confirmed.
Unless the confirmation states otherwise, an invoice is due before the day of service. A booking may be released if an invoice is not settled by the due date. Payment is accepted by the method stated on the invoice, which is issued by the studio accounting process.
Fees are stated in United States dollars unless the confirmation says otherwise. The client is responsible for any tax or bank charge that applies to the payment. Late payment may carry the fee stated on the invoice, where the law permits it.
A client may reschedule a booking by writing to the desk. Where a reschedule is requested with reasonable notice, the desk will move the booking to the next available slot that suits the client. A reschedule with short notice may be treated as a cancellation where the paper has already been cycled and the rig round has already run.
Where a client cancels with reasonable notice, the studio may keep a small booking fee to cover the desk time and the paper that was reserved. Where a client cancels on the day of service, the studio may charge the full fee where the floor could not be rebooked.
Where the studio must cancel or reschedule a booking for a reason within its control, the desk will offer a new slot and will not charge a cancellation fee. Where the studio must cancel for a reason outside its control, such as a power failure or a building issue, the desk will offer a new slot or return any fee already paid for the affected hours.
The desk will confirm any reschedule or cancellation in writing so that both sides have the same record.
The client arrives at the side door at the time written on the confirmation. The desk sends an access note with every confirmed slot, including the window for load-in and where to leave a vehicle. If a crew needs a longer loading window, the client should ask when booking so the door can be held.
Setup and pack down take place within the booked hours unless the confirmation states otherwise. Early access depends on the bay being ready, and the desk will say whether it can be offered. Overrunning the booked hours is an unbooked use under these terms.
The client is responsible for leaving the bay in the condition it was found. Waste, food and loose gear are removed at the end of the session. Tape is lifted from the floor line, and the paper is not walked on in street shoes.
The floor is a working photography space, and the rules exist to keep crews and equipment safe. The client agrees to the following while on the floor.
The studio may end a session if a rule is broken in a way that puts a person, an item or the floor at risk. In that case the fee for the session is not refunded. The studio will explain the reason at the time and confirm it in writing afterwards.
The studio cycles its seamless paper on a weekly rhythm so that every booking starts on clean footage. The client agrees to help keep the paper clean by removing street shoes at the paper line, by keeping food and drink away from the sweep, and by telling the team if paper is soiled during the session.
Where paper is torn or marked by a client or a member of a client crew in a way that requires a cycle ahead of schedule, the studio may charge the cost of the replacement footage. The charge is stated in the confirmation or, where the amount is not known in advance, is calculated from the paper price and the length retired.
A client may request a paper hold for a multi week run. The hold reserves a single roll across the cycle, and the desk will note it in the ledger. A hold that is not used within the agreed period is released and the roll returns to the pool.
The studio provides the lighting and paper described in the run sheet. A light rig round sets the strobes, the modifiers and the flags for the booked service. The client agrees not to change a rig without telling the team, because a small change to a stand or a flag can change the light in a way that is hard to undo.
A client may bring personal equipment, including a camera, a modifier or a roll of paper, with the agreement of the desk. The client is responsible for the personal equipment, and the studio is not liable for a failure or a loss of an item that the client brought to the floor. The studio will store a small item in the office where the desk agrees, but storage is not guaranteed.
Studio equipment is not removed from the building unless the desk agrees in writing. Where an item is returned late or damaged beyond normal wear, the studio may charge the repair or replacement cost.
A print evening is booked separately from a shoot block. The evening starts after the bays close, with the enlarger aligned and the chemistry at temperature. The client follows the induction given by the studio team and uses the chemistry as directed.
Prints are washed, squeegeed and hung to dry on the line under the amber lamp. The studio is not liable for an image that is lost because a negative or a file supplied by the client was faulty, and the studio is not liable for a chemical result that differs from the client expectation where the client supplied the film or the file.
Chemistry is handled by trained studio staff. A client does not mix or dispose of chemistry on the floor, and waste is handled in the way the studio directs.
The pages of this website, including the design of the flash bay navigation, the zone row hero, the backdrop rows, the f-stop band and the contact sheet footer, are owned by CTT MEDIA PRODUCTION INC or licensed to it. The text, the layout and the code may not be copied, reproduced or adapted for a commercial purpose without written permission from the company.
The company name, the studio name and the marks used on this site may not be used in a way that suggests a partnership or an endorsement without written permission. A fair quotation from a page with a clear credit is welcome.
Photographs made on the floor are handled as described in the booking agreement. The studio keeps an archive so that a client can ask for a reprint, and the client can ask for an archive to be deleted as described in the privacy policy.
A client may send a moodboard, a reference image or a written brief to the desk. The client keeps ownership of that content and gives the studio permission to use it for the purpose of preparing and delivering the booking.
The client confirms that it has the right to share the content it sends, and that the content does not breach the rights of another person. If a claim arises from content that the client supplied, the client is responsible for it.
The studio will not publish a client brief or a reference image, except where the client agrees that a frame from the session may be shown in a portfolio. That agreement is recorded with the booking.
A client may bring a crew, a stylist, a model or a vendor to the floor. The client is responsible for making sure that everyone it brings knows the floor rules and follows them. The studio may ask a person to leave the floor if that person puts a person or the paper at risk.
A vendor that delivers paper, equipment or food to the studio does so under the vendor agreement with the client. The studio is not a party to that agreement and is not liable for a delay or a fault in an item that the client ordered from a vendor.
Where a third party crew holds its own insurance, the client should tell the desk before the day of service so the access note can record it.
To the extent that the law allows, the studio is not liable for an indirect loss, a lost profit, a lost booking, a lost reputation or a loss of data that arises from the use of this website or from a booking. The studio is not liable for a fault in a product that the client supplied or for a result that the client directed against the advice of the studio team.
Where the studio is liable, its total liability for a booking is limited to the fee paid for that booking. This limit does not apply to death or personal injury caused by negligence, to fraud, or to a liability that the law does not allow to be limited.
The studio takes care of the floor and the paper, and it inspects a rig before a session. The client should tell the desk straight away if something looks unsafe, so that the team can fix it before work begins.
The client agrees to indemnify the company against a claim, a loss or a cost that arises from a breach of these terms by the client, from content that the client supplied, or from an act of a person that the client brought to the floor. This includes a reasonable legal cost.
The indemnity does not apply to the extent that the claim is caused by the negligence of the company. The company will tell the client promptly about a claim that it intends to recover under this section and will give the client a reasonable chance to respond.
The website is provided for information about the studio and to allow a client to contact the booking desk. The client agrees not to attempt to gain unauthorised access to the site, not to interfere with its operation, and not to use the site to send unlawful, harmful or deceptive content.
The site may be unavailable for a short period during maintenance. The studio does not promise that every page will be available at every moment, and it may change or remove a page without notice.
The contact form on the contact page opens a mail application on the client device. The studio does not operate a server side message store for that form, and a message is not received until the client sends it from that application.
The studio may suspend or end a booking where a client breaches these terms, where a fee is unpaid, or where the safety of a person or the floor is at risk. Where the studio ends a booking for a reason within its control, it will return the fee for the hours not delivered.
A client may end a booking by writing to the desk, subject to the reschedule and cancellation section. The parts of these terms that by their nature survive the end of a booking, including the sections on intellectual property, limitation of liability and indemnity, continue to apply.
These terms are governed by the laws of the State of Texas and the laws of the United States that apply in Texas. A dispute that cannot be resolved by discussion will be brought in a court of competent jurisdiction in Harris County, Texas.
Before a formal step is taken, both sides agree to try to settle the dispute by discussion. The client can start that discussion by writing to bookings@photozonestudio.com, and the company will answer within a reasonable time.
Where the client is a consumer with a mandatory right in the client region, that right is not affected by this section.
The company may update these terms when a service, a provider or a legal duty changes. A new version is posted on this page with a new date at the top. The version that applies to a booking is the version posted when the booking is confirmed, unless the client agrees to a later version.
Please read this page again before confirming a new booking after a long gap. If a change is significant, the desk will add a short notice to the homepage for a reasonable period and will note the change on the run sheet of an affected booking.
Questions about these terms may be sent to the booking desk at bookings@photozonestudio.com or by telephone at +15624437606. The desk answers during business hours and will confirm a written question in writing.
